This Confidentiality Policy (hereinafter referred to as the “Policy”) is an integral part of the Terms of Use of the Website, which are available at the link https://bluebird.com.ua/ugoda-koristuvacha/

GENERAL PROVISIONS

1.1. To carry out the statutory activities of the Foundation and the security of personal data storage of all Users, we hereby provide the information on what data are collected and stored on the website bluebird.com.ua (hereinafter referred to as the “Website”) and for what purpose the Charitable Organization Charitable Foundation “Blue Bird” (hereinafter referred to as “We”, the “Foundation”) uses them. The Foundation is very attentive to the confidential information of all individuals. Therefore, based on the requirements of the Ukrainian legislation and the Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data, the Foundation developed this Policy.

SCOPE OF THIS POLICY

2.1. The Policy applies to personal data collected on the Website. Personal data are the data that personally identifies you, both directly and in combination with other information that is available to the Foundation. Personal include:

  • your name;
  • email;
  • phone number;
  • other personal data that you may provide using the Website or by contacting the Foundation through the Webs

2.2. This Policy does not apply to other resources that may be referenced on the Website. We are not responsible for the confidential policies or the content of third-party resources.

COLLECTION AND USE OF PERSONAL DATA

3.1. The Foundation is the owner and the controller of the Users’ personal data. When using the Website by the User, the Foundation processes the User’s data, namely:

  • data provided by the User when filling out online forms;
  • cookie files;
  • Internet browser settings and parameters.

3.2. The Foundation collects only those personal data (for example, your name and surname, e-mail address, contact phone number, etc.) that are knowingly and voluntarily provided by you as a subject of personal data for the purpose of using the Website services, which, in accordance with the legislation requirements is the consent of the personal data subject to the processing of his or her personal data.

3.3. When visiting the Website, all logins to the system are recorded, as well as other statistics that are necessary for the Website operation. Other information on the User’s traffic is not processed or stored.

USING COOKIE FILES

4.1. Cookie is a text file or files that contain a small amount of information stored on the User’s device. Such devices may include a computer, mobile phone or other device through which the User visits the Website. Cookie files can be permanent (they are called permanent cookie files) and are stored on the computer until the User deletes them, or temporary (such cookie files are called session cookies), i.e. are stored only until the browser is closed. The Foundation cares about its Users and tries to make the stay on the Website as comfortable and safe as possible, for this the Foundation needs to use cookie files to analyze the behavior, preferences and interests of the User. 4.3. The Foundation uses the following categories of cookie files:

  • Mandatory cookie files – are required for the User to navigate the webpage and when using certain services, such as access to secured pages, registration and authorization, search on the Website. They also remember the User’s previous actions when going to the previous page in the same session. The mandatory cookie files that are used:

  • _csrf – to protect against CSRF-attacks (Cross Site Request Forgery – also known as CSRF).

Examples of such data are the following metrics: time spent on the Website, the most frequently visited pages, understanding which sections and services of the Website were most interesting for the User, etc. All information collected through operational cookie files is intended for statistical and analytical purposes. PURPOSES OF USING YOUR PERSONAL INFORMATION

5.1. We use the personal information obtained by the Website for the following purposes:

  • for charitable activities on your behalf or in your interests;
  • ensuring security and preventing any illegal actions and preventing fraud;

PROCESSING A SPECIAL DATA CATEGORY

7.1. The Foundation does not intend to process data on:

  • racial or ethnic origin;
  • political, religious or ideological beliefs;
  • membership in political parties and trade unions;
  • conviction to criminal punishment;
  • health, sexual life, biometric or genetic data.

7.2. With your consent and for the purposes of the Foundation, we process and/or publish the above categories of data for charitable purposes (for example, a description of difficult life circumstances helps to collect donations). In some cases, without your special consent, impersonal and statistical data (number of drugs, disease statistics, volumes of targeted donations, etc.) may be used, which are not personal data.

YOUR RIGHTS

8.1. According to the Law of Ukraine “On Personal Data Protection” you have the following rights:

  • to know about the sources of collection, location of your personal data, the purpose of their processing, location or place of residence (stay) of the owner or the controller of personal data or give appropriate instructions to obtain this information to authorized persons, except as provided by law;
  • to receive information on the conditions for providing access to personal data, in particular information on third parties to whom his personal data are transferred;
  • to access to your personal data;
  • to receive no later than thirty calendar days from the date of receipt of the request, except as provided by law, an answer as to whether his personal data are processed, as well as receive the content of such personal data;
  • to make a reasoned request to the owner of personal data with an objection to the processing of your personal data;
  • to make a reasoned request to change or destroy your personal data by any owner and the controller of personal data, if these data are processed illegally or are inaccurate;
  • to protect your personal data from unlawful processing and accidental loss, destruction, damage due to intentional concealment, non-provision or late provision, as well as to protect against the provision of information that is inaccurate or discredits the honor, dignity and business reputation of the individual;
  • to apply to the Commissioner or the court with complaints about the processing of your personal data;
  • to apply legal remedies in the case of violation of the legislation on personal data protection;
  • to make reservations regarding the restriction of the right to process your personal data during the consent;
  • to withdraw consent to the processing of personal data;
  • to know the mechanism of automatic processing of personal data;
  • to protect against an automated decision that has legal consequences for him.

8.2. If you are subject to foreign law, such as GDPR, CalOPPA, the Foundation recognizes your privacy rights in accordance with global practice and complies with your legal requirements.

ADVERTISING, ANALYTICS AND SERVICES PROVIDED BY THIRD PARTIES

9.1. The Foundation may allow third parties to provide contextual and other advertisements and provide analytical services related to the Website operation. Such persons may use various identifiers to collect information about the program use, including your IP address, MAC address, device identifiers, software and hardware information, time zone and usage information. This information may be used by the Foundation and others, among other things, to determine the popularity of certain content, to provide advertising, and to better understand your activities on the Website.

INFORMATION STORAGE
